Abstract

This study compares the perspectives of Brazil and China on international law, exploring how their historical trajectories, legal foreign policies, and regional contexts have shaped their approaches. The first section identifies the intellectual influences underpinning their internationalist visions, highlighting how historical traditions have shaped their attitudes toward international law. China adopts a dual approach: it seeks to influence the development of international law while maintaining a distrust of its instrumentalization by major powers. In contrast, Brazil emphasizes multilateralism and the defense of national sovereignty, influenced by its Roman-Germanic legal tradition and its role in Latin America. The second section examines the convergences in the foreign policies of both states, suggesting the possibility of a common Sino-Brazilian view of international law. Finally, the joint proposal of Brazil and China regarding the war in Ukraine is analyzed, illustrating how both countries apply their principles of international law in a complex context. The conclusion is that Brazil and China have similar positions in international law, though nuanced by quite distinct theoretical frameworks and historical experiences.
