From the intersection between International Law and International Political Economy, this article aims to reread Susan Strange's contributions and apply them to the investor-state dispute settlement regime, a topic that was not studied by the author. Therefore, the article examines how the retreat of the State impacts investor-State dispute settlement regime; and how the structural power of transnational corporations is expressed in specific cases of disputes. The article closes by linking the previous ideas to the covid-19 pandemic crisis and the “return of the State”.
