Reflexionando sobre las contribuciones del Derecho Internacional a la resolución de los desafíos globales actuales y futuros
Recientes acontecimientos y desarrollos internacionales desafían el orden jurídico, político, económico y moral predominante durante el Siglo XX. Como resultado, se intensifican las críticas a la eficacia del derecho internacional, cuestionando su capacidad para garantizar una gobernanza global efectiva. Las críticas se expresan tanto respecto a problemáticas tradicionales y recurrentes, como el mantenimiento de la paz y seguridad internacional en contexto de conflictos armados entre Estados, como respecto a nuevas dinámicas observadas en respuesta al desarrollo tecnológico, incremento de los efectos del cambio climático, surgimiento de nuevos sujetos de importancia internacional, mayor interconectividad entre los Estados, entre otros.
La Revista Tribuna Internacional invita a contribuir a una edición especial, con artículos científicos, ensayos, comentarios de jurisprudencia o reseñas de libros que reflexionen sobre los desafíos que enfrenta el Derecho Internacional en el contexto actual, y su relevancia como herramienta para la articulación de soluciones colectivas y efectivas.

Reflecting on the Contributions of International Law to Resolving Current and Future Global Challenges
Recent international events and developments challenge the legal, political, economic, and moral order that prevailed during the 20th century. As a result, criticisms regarding the effectiveness of international law are intensifying, questioning its capacity to guarantee effective global governance. These critiques address both traditional and recurring issues, such as the maintenance of international peace and security within the context of armed conflicts between States, as well as new dynamics observed in response to technological development, the escalating effects of climate change, the emergence of new actors of international significance, and increased interconnectivity between States, among others.
The Revista Tribuna Internacional invites contributions for a special edition, including scientific articles, essays, case law commentaries, or book reviews that reflect on the challenges facing International Law in the current context, and its relevance as a tool for articulating collective and effective solutions.
The unanimous judgment the International Court of Justice in November 2012 which resolved the boundary dispute between Nicaragua and Colombia in the western Caribbean Sea has generated considerable attention and commentary. Almost all of it has been highly favorable, with the sole exception of the reaction by Colombia, which purported to “reject” the Court’s Judgment and commenced procedures to withdraw its acceptance of ICJ jurisdiction in regard to future cases. This article demonstrates that the Court’s Judgment reflects the application of well-established legal principles of maritime boundary delimitation, and results in an equitable solution that is balanced and fair to both Parties. By analyzing the unique geographical circumstances of this case and discussing the methodologies and reasoning the Court employed in these circumstances to delimit the disputed maritime area, the article demonstrates that the delimitation line established by the Court was a creative solution to a difficult and complex geographic situation, which at the same time is firmly rooted in and consistent with well-established jurisprudence. As a result, the maritime boundary that the Court fixed between Nicaragua and Colombia allows the coasts of both States to generate maritime entitlements in a reasonable and mutually balanced way. Not only is the Court’s Judgment equitable to both Parties; it is also legally binding on them. There is no basis for either State to “reject” it, and no justification for refusing to entrust future cases to the Court, which remains an indispensable forum for the peaceful resolution of disputes between States according to the rule of law.
